Welcome to Hoozir, a social app that allows you to check in to your favorite places and meet others who have also checked in if there is mutual interest. By using our services, you agree to be bound by the following Terms of Service. Please read them carefully.

1. Account Registration and User Information

1.1 To use Hoozir, users must create an account using a valid email address. You are responsible for providing accurate and up-to-date information during the registration process.

1.2 Users must be at least 13 years of age to use Hoozir. Users aged 13 to 17 will be designated in one section of the app, while users aged 18 and above will be in a separate section.

1.3 As part of the registration process, users are required to provide gender information and specify the types of matches they are looking to meet, such as dating, friendship, etc.

1.4 You are solely responsible for maintaining the confidentiality of your account credentials. Any activity that occurs under your account is your responsibility.

2. Location Services

2.1 Hoozir uses location services to allow users to check in to their favorite places. We only retain records of the places users have checked in. If users enable background location detection for nearby venues, this data is not stored.

2.2 By using location services, you agree to Hoozir's Privacy Policy regarding the collection, use, and storage of location data.

3. Meeting Others and Communication

3.1 Hoozir employs a matchmaking algorithm that applies each user's filters to deliver profiles randomly. Communication between users is only allowed if there is mutual interest.

3.2 You are solely responsible for any communication and interaction with other users through the app. Hoozir does not endorse or verify the accuracy of user-provided information.

4. User-Generated Content

4.1 Users may create profiles with text and pictures. Additionally, users can engage in chats with other users.

4.2 Hoozir reserves the right to review and moderate user-generated content to restrict any inappropriate photos or text that violate our guidelines.

5. Privacy

5.1 Hoozir takes user privacy seriously. Please refer to our Privacy Policy for detailed information on how we collect, use, and store user data.

6. Payment Processing

6.1 We use Stripe for payment, analytics, and other business services. Stripe collects and processes personal data, including identifying information about the devices that connect to its services. Stripe uses this information to operate and improve the services it provides to us, including for fraud detection and prevention. 7. Intellectual Property

7.1 All content and intellectual property rights related to Hoozir, including user-generated content, belong to Hoozir Inc.

8. User Safety and Conduct

8.1 Hoozir aims to provide a safer environment for people to meet by maintaining records of user interactions. However, users are encouraged to exercise caution and report any suspicious or inappropriate behavior.

8.2 If there is any suspected behavior involving child sexual abuse and exploitation (CSAE), we ask that you flag/report that profile in the app and send any additional details to safety@hoozir.com

9. Limitation of Liability

9.1 Hoozir and its affiliates shall not be liable for any damages, losses, or liabilities arising out of or in connection with the use of the app.

10.1 The app does use third-party services that declare their Terms and Conditions.

11.1 Hoozir may update these Terms of Service from time to time. The latest changes will be marked in the "Terms" section of the app/website.

12. Governing Law

12.1 These Terms of Service shall be governed by and construed in accordance with the laws of the United States.

Terms & Conditions

By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to Flambeaux Ventures.

Flambeaux Ventures is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

The Hoozir app stores and processes personal data that you have provided to us, to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Hoozir app won’t work properly or at all.

You should be aware that there are certain things that Flambeaux Ventures will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but Flambeaux Ventures cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, Flambeaux Ventures cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Flambeaux Ventures cannot accept responsibility.

With respect to Flambeaux Ventures’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Flambeaux Ventures accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for the both systems(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. Flambeaux Ventures does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
